On October 20, 2022, the Public Utility Commission of Texas adopted two new rules – 16 TAC § 24.173 and § 24.364 – to implement the requirements of Sections 13.151 and 13.414 of the Texas Water Code, which prohibit late fees and disconnections for nonpayment of utility bills due during an “extreme weather emergency” and establish related penalties.  PUC Rule 24.173(d) requires districts that provide retail water or sewer service to send a one-time notice regarding the new rules to each customer on or before January 31, 2023.  Such notice, which can be downloaded  TC2PUC here, was included in the January utility bills.
